SMS Privacy Policy
This SMS Privacy Policy describes how S. MacDonald Contracting LLC, also known as SMC Contracting (“SMC,” “we,” “us,” or “our”), collects, uses, and protects mobile phone numbers and related information in connection with the WorkHub SMS Notification Program (the “Program”). WorkHub is SMC’s internal field-operations and ticketing application. It is used only by SMC employees and is not available to the public.
This policy applies to text messaging only. Our SMS Terms & Conditions are available at SMS Terms & Conditions, and a description of the Program and how consent is collected is available at SMS Notifications Program.
1. Who Receives Messages
Program messages are sent only to SMC employees who have agreed to receive them. We do not send text messages to customers, vendors, or the general public through the Program.
2. Information We Collect
- Mobile phone number — the number on your WorkHub account, entered by an authorized SMC administrator when your account is created. No Program message is sent to it until you have agreed at sign-in.
- Consent record — your agreement to receive Program messages, recorded when you check the consent box at sign-in, with the date and time.
- Your name and role — so that you receive only the messages relevant to you.
- Message activity — the messages we send you, any replies (for example STOP or HELP), and delivery status information from our messaging service provider.
3. How We Use Your Information
We use the information above only to operate the Program:
- Send status updates on work tickets and trucking tickets you created or need to approve (for example “approved,” “rejected,” or “needs your review”).
- Respond to STOP and HELP requests and keep records of consent and delivery as required by law and wireless carrier policies.
The Program is informational and transactional. We do not send advertising or promotional messages, and we do not send WorkHub account invitations or PIN resets by text message.
4. Mobile Information Is Not Shared
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We share mobile phone numbers only with the service providers that deliver text messages on our behalf (our SMS platform provider and the wireless carriers), and only for that purpose. We may also disclose information if required by law, subpoena, or court order.
5. How Consent Is Collected
You will receive Program messages only after you have agreed to receive them. Consent is collected on the WorkHub sign-in screen: before signing in, you must check a required consent box that includes the message-and-data-rates disclosure, message frequency, STOP and HELP instructions, and links to these policies. The box is unchecked by default and sign-in cannot proceed without it. Your agreement is stored against your account with the date and time. No message is sent to your number until that step is complete. Consent to receive text messages is not a condition of employment. 6. Message Frequency and Cost
Message frequency varies with your ticket and approval activity. Message and data rates may apply according to your mobile plan. SMC does not charge for Program messages.
7. How to Opt Out or Get Help
Reply STOP to any message to stop receiving texts. You will receive one confirmation message and no further messages will be sent to your number. Reply START to resubscribe. Reply HELP for assistance, or contact your SMC administrator using the information below. If you opt out, you will no longer receive WorkHub notifications by text; you can continue to use the WorkHub app.
8. Data Retention
We keep mobile phone numbers and consent records for as long as you participate in the Program and for a reasonable period afterward as needed to document your consent and opt-out and to comply with legal and carrier requirements.
9. Security
Mobile phone numbers are stored within WorkHub’s access-controlled systems and are available only to authorized SMC personnel and the service providers described above.
10. Children
The Program is intended for adult employees. We do not knowingly collect mobile phone numbers from anyone under 18.
11. Changes to This Policy
We may update this policy from time to time and will revise the effective date above when we do.
